2. Services Provided
Hyzr offers ride-hailing services for passengers and parcel delivery services for users who need items transported. Hyzr acts as an intermediary to connect users with independent drivers and delivery partners.
3. User Accounts
You must create an account on the Hyzr App or Website to use the services. You agree to provide accurate and up-to-date information.
You are responsible for safeguarding your account details and for any activity under your account.
4. Driver and Delivery Partner Responsibilities
All drivers and delivery partners are independent contractors, not employees of Hyzr.
They are responsible for ensuring the safety and timely arrival of passengers and packages.
Drivers and delivery partners must comply with local safety and operational regulations.
5. User Conduct
Users must adhere to respectful and lawful behavior when using the app or website and interacting with drivers or delivery partners.
Misconduct, harassment, or violation of laws will result in account termination.
6. Pricing and Payments
Ride and delivery fees are calculated based on distance, time, and other factors. Prices are displayed before booking on both the app and website.
Payments must be made through the app or website using the available payment methods (e.g., Razorpay integration).
7. Insurance and Liability for Parcels

Users are responsible for ensuring their parcels are appropriately packaged for safe transport. Hyzr and its delivery partners are not liable for damages caused by inadequate packaging.
8. High-Value Packages
For parcels with a declared value exceeding INR [amount], users must select the "High-Value Package" option, which may incur additional fees.
Hyzr may offer enhanced insurance coverage for high-value packages upon request. Users must declare the item’s value accurately; misrepresenting the value may void any insurance claims.
9. Offers and Promotions
Hyzr may, from time to time, introduce promotional offers, discounts, or credits for ride-hailing or delivery services on the Hyzr App or Website.
Promotional offers are subject to terms specified at the time of the promotion and may be limited by duration, availability, and specific terms such as minimum booking requirements.
Offers cannot be combined with other discounts or promotions unless otherwise stated.
Hyzr reserves the right to modify, suspend, or terminate any promotional offers at its discretion, with or without notice.
Any misuse or fraudulent use of promotional offers may result in the cancellation of the offer and possible suspension of the user account.
10. Referral Program
Hyzr may offer a referral program where users can refer friends or family to join the Hyzr platform and receive rewards.
Referral rewards are subject to terms outlined at the time of the referral and may be conditional upon the referred user completing a specified number of rides or deliveries.
Referral rewards are non-transferable, non-exchangeable, and may have expiration dates.
Any abuse of the referral program, such as creating fake accounts or self-referrals, will result in forfeiture of referral rewards and may lead to account suspension.
Hyzr reserves the right to modify, suspend, or terminate the referral program at any time, with or without prior notice.
11. Cancellation and Refunds
Cancellations are allowed within specified timeframes. After that, a cancellation fee may apply.
For deliveries, cancellations may incur a charge if the driver or delivery partner has already picked up the package.
Refunds for completed rides or deliveries are subject to review and approval by Hyzr.
12. Privacy Policy
We collect and process personal data as outlined in our Privacy Policy. By using the Hyzr App or Website, you consent to the processing of your data as described therein.
13. Liability Limitations
Hyzr is not liable for any loss, damage, or delay of parcels during transit, except where insurance coverage applies.
We do not guarantee uninterrupted access to the app or website and are not responsible for any issues related to their availability.
Hyzr is not responsible for damages, losses, or delays resulting from circumstances beyond our control, including natural disasters or accidents.
14. Safety and Compliance Requirements for Drivers
All drivers and vehicles must meet safety and regulatory requirements, including regular vehicle inspections and adherence to local driving laws.
Drivers are required to maintain personal and vehicle insurance as per local regulations.
15. Amendments to Terms
Hyzr may update these Terms periodically. Continued use of the Hyzr App or Website after updates signifies acceptance of the revised Terms.
16. Termination of Access
Hyzr reserves the right to suspend or terminate access to the Hyzr App or Website for users violating these Terms.
17. Dangerous Goods / Security
Dangerous Goods
We do not carry, nor perform other Services regarding, goods which are in our sole opinion Dangerous Goods, including but not limited to those specified in the regulations, guidelines, technical instructions, and codes applicable to us and our business or to the transport of, or the performance of other Services regarding, Dangerous Goods.
We may, at our discretion, accept some Dangerous Goods for carriage or for the performance of other Services in some locations if you have been accorded the status of an approved customer. This must be granted by us in writing before your consignment can be accepted. Your Dangerous Goods will only be accepted if they comply with the applicable regulations and our requirements. Details of our requirements, together with the procedure for applying for approved customer status, are available from our nearest office. A dangerous goods surcharge will be invoiced to you upon acceptance of your consignment.

We do not accept consignments that contain prohibited items.
Declaration of Goods
We accept consignments only upon your declaration of the type and value of the consignment (“said to contain” basis). We have no responsibility whatsoever as to the correctness of the description, type, or value thereof. You agree to indemnify us and hold us harmless from any claims that may be brought against us arising out of or relating to such declaration provided by you and any costs we will incur in relation thereto.
18. Governing Law
These Terms are governed by the laws of India. Any disputes arising from these Terms shall be resolved in the courts of Kerala.
19.GST
• GST, as applicable, will be levied on the Invoice.
• Any information shall be considered only prospectively. Under no circumstances, will invoices be revised retrospectively for delay in providing GST registration information.
• Taxes on reverse charge mechanism, wherever applicable, shall have to be paid by the recipient of services.

5. Disqualification:

1.1. Absolute Responsibility: Delivery personnel are fully responsible for the safety and security of parcels in their possession. Any negligence leading to loss or theft will result in strict disciplinary action, including termination and legal consequences.
1.2. Mandatory Inspection: Delivery personnel must check parcel condition upon pickup and delivery. Any damage or irregularity must be reported immediately before proceeding.
1.3. Secure Handling: Parcels must never be left unattended under any circumstances. If a parcel is left unsecured, the delivery personnel will be held directly accountable.
2.1. Immediate Reporting: Any loss or theft must be reported to the company within one hour of discovery. Failure to report will result in severe penalties, including possible salary deduction or job termination.
2.2. Evidence Submission: The delivery personnel must provide a written explanation along with any available evidence (CCTV footage, delivery logs, witness statements, police reports, etc.).
2.3. Internal Investigation: The company will conduct a strict investigation. If found guilty of misconduct or negligence, the personnel will be liable for full compensation of the lost item and may face legal action.
2.4. Police Involvement: In case of theft, the company will immediately file a police complaint, and the delivery personnel may be required to cooperate in the investigation.
3.1. Zero Compensation from Company: Hyzr Transportations and Services Pvt Ltd will not be responsible for compensating the customer unless the loss was due to a company process failure.
3.2. Employee Liability: If a delivery person is found responsible for the loss, they must pay for the full value of the lost item. The company reserves the right to deduct the amount from their salary or legal settlement.
3.3. Customer Complaints: Any customer complaints regarding missing or stolen parcels will be strictly reviewed, and repeated complaints against delivery personnel will result in immediate termination.
4.1. Mandatory Proof of Delivery: Delivery personnel must collect the recipient’s signature or OTP verification for every parcel.
4.2. No Unauthorized Handling: Only the assigned delivery personnel should handle the parcel. Sharing or transferring the parcel to another person without permission is strictly prohibited and will result in termination.
4.3. High-Risk Area Protocol: In high-risk areas, additional security measures such as real-time tracking updates and supervisor notification are mandatory.
4.4. Periodic Security Audits: Random parcel checks will be conducted, and any irregularity will result in disciplinary action.
First Offense: Salary deduction + Written warning.
Second Offense: Suspension + Full liability for lost items.
Third Offense: Immediate termination + Legal action (if applicable).
